In this case the tenant who tried to apply his rights under the RLTO learned that the RLTO does not apply to a separate coach house that is not owner occupied if the owner does occupy the main house on the same parcel.  Even though the landlord does not live in the coach house, the coach house is still owner occupied because the landlord does occupy the main house, and the coach house is a part of the landlord's dwelling unit in the main house.  The court noted that both buildings were on the same parcel with the same tax identification number.

The Court concludes by reminding us that:

"We agree with the special concurrence in Allen that the city council intended to except from the requirements of the RLTO owners who live in the same building as the unit of the tenant seeking to invoke the protections afforded by the RLTO."
